Rules and guidelines
These Rules supplement the Terms and Conditions and the Privacy Policy and govern the rules of conduct within the Burraconline game and community. Their acceptance is mandatory in order to use the Service. Nothing in these Rules limits the mandatory rights granted to the user by law, including the right to bring proceedings before the competent judicial authority and to lodge a complaint with the data protection supervisory authority.
1. User obligations and prohibitions
1.1 It is expressly forbidden for users to send abusive, defamatory, hateful messages, messages offensive to an individual or to the entire community, threatening messages and the like, or any other material that may breach the applicable law. Such messages will be hidden or deleted at the unappealable discretion of the site administrators. Users acknowledge the administrators' right, at their unappealable discretion, to ban the offender from the Service temporarily or permanently.
1.2 Users are solely responsible for the messages they write in the chat and for their content. Moderation is aimed exclusively at the censorship or removal of messages manifestly contrary to common morality, at the unappealable discretion of the administrators. If a user believes they have received an offence or defamation, they may contact the law enforcement authorities by filing a formal complaint, specifying their reasons and the nickname from which they believe they received such offences. It is not the task of the administrators or moderators to verify the truthfulness of messages written by users.
1.3 Any breach of the above prohibitions, deemed such at the unappealable discretion of the administrators, will be pursued as set out in the section “Procedures for intervention, warnings, ban and dumb”.
1.4 Publicly arguing about the conduct of the Staff is not permitted, unless users' opinion is expressly requested by a member of the staff.
1.5 The choice of nickname and avatar must not contain phrases, words, representations or concepts offensive to any person, race, religion, political and/or sexual orientation, nor names or references to well-known political figures, nor explicit, direct, indirect or otherwise ambiguous sexual references. It must also not create confusion about the user's possible membership of the site staff. Nicknames created in such a way will be immediately deleted and, if an Elite subscription has been purchased, it will be cancelled without the possibility of a refund.
1.6 Users are not allowed to use the table chat, two-way chats or whispers to organise meetings and gatherings among users, as such activity is reserved exclusively for the site administrators.
1.7 The nickname and its password are strictly personal, must be properly safeguarded and may not be made public nor transferred, given away or sold to others. It is also expressly forbidden to provide one's access data to third parties in order to “share” a nickname among several people, or to have them pay for one's Elite subscription.
1.8 Custom avatars submitted by users enabled for this function are, before publication, subject to approval by the staff and presuppose the existence, on the user's part, of the legal authorisation for their disclosure. The user holds Siesta Soft S.L. harmless from any liability. The staff will reject avatars that may harm common morality, that depict minors, that infringe copyright or that are simply not considered acceptable, at their unappealable discretion and without giving any explanation. The staff may delete already approved avatars or completely block access to the game in the most serious cases.
1.9 It is expressly forbidden to provide false data during registration. The user confirms that the data provided during registration, in particular the email address, is truthful and attributable to them. Users registered with false data will be immediately deleted or suspended and may be subject to a formal complaint to the competent authorities.
1.10 Email addresses that have fallen into disuse or are no longer reachable must be replaced with a new address. The email change can be made independently through the in-game account function, or requested at the address : support will reply explaining the procedure to follow. The email address is essential for recovering a nickname whose password has been forgotten. Siesta Soft S.L. is in any event relieved of the responsibility to provide an alternative method to email for account recovery.
1.11 The use of the chat is granted only temporarily and may be suspended at the unappealable discretion of the staff and administrators, even without giving any explanation. In general, the chat is granted only to users who demonstrate that they know how to use it with full respect for others and who have not breached any rule of conduct in these Rules. The chat may therefore be disabled even for paying “Elite” users.
1.12 It is strictly forbidden to advertise other sites within the game, whether competitors or not, either by directly posting urls/links or by spreading their name. The chat may not be used for advertising or propaganda purposes of any kind.
1.13 - Maximum one nickname per person. The game is free for a maximum of one nickname per person, per email or per device used. Siesta Soft reserves the right to decide, on a case-by-case basis, which multiple nicknames to “tolerate” and which not. Additional nicknames may require a mandatory upgrade to Elite in order to keep playing. The use of different computers or different emails in order to circumvent this limitation is punishable by the blocking of one or more nicknames that Siesta Soft, with reasonable certainty, considers linked to or belonging to the same person or household connecting through the same workstation, internet connection or device.
1.14 - Right of withdrawal. In the event of an upgrade to the paid version (“Elite”) or the purchase of virtual tokens, the user loses the right of withdrawal as provided for and governed by article 6.4 of the Terms and Conditions. By accepting these Rules, which is mandatory in order to use the game, the user expressly accepts such loss of the right of withdrawal.
2. Rights of the site administrators
2.1 Users acknowledge the full right of the administrators to exclude them, at their unappealable discretion, from the Service or the chat, even without notice or explanation. Argumentative or aggressive tones are not welcome.
2.2 In order to curb the conduct prohibited by these Rules and by law and to allow easy identification of the offender, the user is aware - and expressly consents - that the Burraconline software is able to identify their device by generating an identifier based on certain characteristics of the device on which it is installed. The user expressly acknowledges the administrators' right to inhibit access to the game for any new nickname created from the same device identified as an offender. The processing of this data is described in the Privacy Policy.
2.3 Also in order to curb prohibited conduct, the user is aware that their conversations in the chat, both at the table among several people and in private via two-way chats or whispers, may be recorded and retained for the time necessary for the security and moderation purposes described in the Privacy Policy. Such recordings may be used by the administrators, on their own initiative or following a report by other users, for the adoption of the disciplinary measures provided for in these Rules or for reporting to the competent authorities. The user expressly authorises Siesta Soft S.L. to make such recordings.
3. Procedures for intervention, warnings, ban and dumb
3.1 In the case of conduct deemed - at the unappealable discretion of the administrators and without any obligation to justify it - incorrect, serious, denigrating, offensive or not in line with the Service's policy, the user may be contacted privately or publicly and urged to change their attitude, and/or may be excluded, temporarily or permanently, from the Service, even without warnings. The user expressly accepts that they may be subject to actions such as the inhibition of the chat (DUMB) or the blocking of the connection to Burraconline via the game client (BAN), either temporarily or indefinitely, by automated filters or by the administrators. The duration and methods of DUMB and BAN measures are at the total and unappealable discretion of the administrators.
3.2 Any form of disruption (by way of example, message flooding, harassing private messages or the like) will be immediately pursued by the administrators, on their own initiative or following a report by other users, and those responsible may be permanently banned from the Service without notice.
3.3 Users acknowledge the administrators' right to ban or temporarily exclude (kick) individual users from the Service, identified through their nickname or their access device. In the case of identification through the device, even the creation of new nicknames results in the impossibility of connecting to the game.
3.4 Should a banned user continue to re-register, even using different nicknames, different devices or different email addresses, with the aim of contesting, disrupting or hindering the normal conduct of the Service's activities, of users or of the staff's work, the administrators will report the matter to the competent authorities. Should intervention measures become necessary on paid Elite nicknames, the user expressly accepts the immediate cancellation of the subscription or tokens purchased, without the possibility of a refund.
3.5 Account blocks resulting from breaches attributable to the user that prevent access to the game will NOT give rise to any refund on Elite subscriptions or tokens purchased.
4. Disclaimer of liability
4.1 To the extent permitted by law, Burraconline.com and Siesta Soft S.L. are not liable for malfunctions or damages resulting, directly or indirectly, from the installation or use of the game software. Siesta Soft S.L.'s liability remains in the cases provided for in article 12 of the Terms and Conditions and in any other case in which liability cannot be excluded or limited under the applicable law (in particular for wilful misconduct, gross negligence or damage to life, physical integrity or health).
5. Account deletion and reactivation request
5.1 The request to delete one's account must be made directly from within the game. If the user is no longer able to access it, they may request deletion by email at the address , specifying their nickname: support will reply explaining the procedure to follow and the necessary checks. Deletion is a right of the user and is guaranteed, except where the retention of data is necessary to comply with legal obligations (in particular accounting and tax), to manage disputes or requests from the competent authorities, or for Siesta Soft S.L.'s legitimate interest in preventing the circumvention of bans and preventing fraud.
5.2 The deletion procedure consists of two phases: “temporary retention” and “definitive deletion”. During “temporary retention”, the nickname data covered by privacy is protected through irreversible hashing (one-way encryption) and the nickname is disconnected from all public scores, profiles and public statistical data. The nickname enters “definitive deletion”, with the removal of records from the database and the release of the nickname, only once 5 years have elapsed from the deletion request, and only provided that there are no other contractual, fiscal or legal constraints, or ongoing blocking measures. The user expressly authorises Siesta Soft S.L. to retain their data for the period necessary for the purposes described, in line with the Privacy Policy.
5.3 Provided that the conditions defined by these Rules, the Terms and Conditions and the Privacy Policy allow it, and always at the discretion of the administrators, a user with a nickname in “temporary retention” may request the recovery of the deleted nickname. Recovery will entail the mandatory upgrade to the paid service (“Elite”).
5.4 In any case, the user requesting reactivation must demonstrate that they know the password of the previously deleted nickname and that they are the holder of the email address linked to it, failing which it will not be possible to proceed.
5.5 All unused nicknames will be deleted automatically. Excluded from automatic deletion are nicknames that have made at least one purchase (since the law requires the retention of the relevant data), those that have been subject to measures (for example, BAN) or that have been involved in an extended block, and those currently subject to legal proceedings. Automatic deletion also entails the removal of the nickname from the friends list and the blacklist of other users.
If you do not agree with these Rules and have already installed the game, you may reject them and proceed to uninstall and remove the software from your devices.
